Although she has no intention of moving with you, if anything happened to your ex wife, this would change. My children from my first marriage also had to be on the application as well as have medicals for this very reason.
I'm sure if anyone can find a solution, Gill can. Good luck with it.

Yes this is the final decision we have sent our letter of "natural justice" but they stuck with there first decision.
We do have the chance of a MRT but very costly and been advised not to persue as diac would probabily not change there mind.

Hi ozzieclare

We have appealed and we do have an agent but it looks like it was the agents fault ,he should have looked at our case as it was going along but he did not I think and just trusted one of his employees to do it.

re apply

G'day guys

Looks like we wiil have to re-apply next year when my daughter will be independent, so can I ask you all as a fellow carpenters and scots (sorry) brits, can you ask your employers if they could sponser a realy good carpenter/joiner with many years exspereance starting next year 1/2/11 as my daughter will be 18 and dependent.
This I know as she is going to college in the summer and wiil get a job.

Hi Stuart,

Sorry to hear your bad news you must be pretty upset. We used Visa Bureau to get us out here and they were fantastic we only had a short time before my husbands 45th and they rushed us through and were fantastic, maybe they could advise you what to do next.

Get in touch with George lambard you will find him on poms in oz. He has helped people with appeals and won. You will have to pay for his services but he will be able to tell you if you have a chance. You say gill has helped you she will know who he works for. Best of luck.

There is an agent in oz who specifically deals with cases like yours. I think his name is Peter Bollard (not sure if that is his last name) He has helped lots of people on british expats in similiar cases to yours . Go onto www.britishexpats.com and ask. He specialises in visas that could fail due to medical reasons. If he can't help you then no one can .

One you you should look at is a refusal by your ex wife to allow a medical. This is common where ex wife refuses to assist your migration. You will need an audit trail of la etter where she refuses due to a break down of communication. Once you have a letter saying she refuses you should then get a formal letter from your legal person to confirm this. I did this via global visa's and they were very good and had some previous cases as a history of it happening before.

Not sure if you can apply again but this may be a way round it for you, this is not an ideal route but one you could look at. This is how I over come the medical test for my daughter who was 17.
