I have just had a 2 hr conversation with SA Immigration and DIAC (with all the 'holds' they put you on!!) as we are on a 495 visa (which I have been told has been superceded by the 475) and it seems that if the people posting on here who have been declined the PR 887 visa AFTER meeting the requirements and been declined with out a reason, would have valid case on Human rights grounds. DIAC have confirmed they are able to decline Visa's if the relevant 887 criteria (as detailed on the website) are not met AND when they decline, a reason HAS to be given in WRITING to the Visa holder!!
I am now going to double check everything before I make a long term decisions.......................but if anyone has been declined without a written reason, SA Immigration want to hear about it and it would be good to hear about it.................

Pretty much - yes - they indicated that, as per your analogy of provisional driving licence, if you can prove with evidence you can meet the criteria, it is straight forward - you get PR. When I asked what they can decline on, they said a decline tends to occure due to failure of one or more of the criteria.....................or a seperate matter such as a criminal record whilst in Oz. I gather they can be quite throrough and may ask for loads of supporting info, so I guess it is a case of keeping everything until you apply!!
But, for me, the most important bit is, THEY MUST PROVIDE IN WRITING A REASON FOR THE DECLINE - this was clearly pointed out as it would be against human rights to refuse entry at this stage of an application if all criteria was met.

Well done Tom and thanks for sticking at it. Let's hope that puts the handful of s***stirrers on this site back in their box for a while.
