SIR temp 496 - To perm 887?

Hi all,

 

well I am looking to pick all your brains again!

 

We will have been here for 2 years come 2nd March and are looking to find out the information that is required by us to submit an online application for permanent residency.

 

Our SIR temp 496 is similar to the 495 only we are family sponsored, we want to gather as much of the information as we can just now so that come the 2nd March we can get everything uploaded and sent to the person with the stamp that says "Yes, visa granted!"

 

Your knowledge and experience on this one would be greatly appreciated so that I can get a head start on it.

 

(please copy and paste to your response so that I have a full list of what is required)

 

What information is required:

1. I am presuming rental references for the two years we have been here.

2. Work/tax details to say that we have met the working criteria of 1 year full time employment out of 2 years we have been here.

3. Statement by family member for sponsorship completion.

We are in the same position as you although we've decided to wait another 15 or so weeks before we apply to ensure we cover the essential work requirement of a minimum of 52 weeks of full time work (or 2 part time jobs adding up to that value - which is the position we find ourselves in).

A utility bill for every month

A wage slip for every month showing you have worked over 35 hours.

Federal police check.

If scanned in colour they dont need to be certified if you are applying online.

I understand that you're self employed which means payslips are a no-no. In that case I think you need to provide evidence of ABN, Tax returns, invoices to clients etc - maybe a call to DIAC is in order to clarify how to best evidence self employment?

Hi,

I made a call to the DIAC, in additon to what you have already mentioned, bussiness registration if you have a registered bussiness, reference from your accountant, letters from anyone of good standing stating you are actively envolved in the day to day running of your bussiness, and also a stat dec, the DIAC stat dec form is on their web site, I could email it to you if you cant find it, the did tell be that they take them seriously.

I didn't think you would need wages slips...I thought you annual payment summary would be ok:shocked: and I don't know if I have all utility bills, would letter from rental and mortgage statements do? or letter from kids school stating how long they have been there?

 

Cornelia I thought someone said before you can apply the month before so if you have gathered everything you can send in all in on the 2nd Feb!! not totally sure so maybe someone else can verify this

oh yes, school reports are important because they show you have been living here.

We were told to prove every month we had been here- kept every bill I had.

Took ages for the jp to certify them.

Didn't think you could apply early if doing it online as the computer wont allow you access after you've put your passport number in - maybe someone who has done this could verify this or not.

I just sent a sample of payslips and utility bills (I didn't have bills for my first 18 months as my rent included all bills), I think about 4 of each in total, covering a range of dates, along with the letter from my employer, rental reference, current lease agreement and police check. Had no problems with just those.

The way I read the info on the immi website is that we will all have to have meds and xrays done again, is that right? I seem to remember that some folks get off with using their original meds...Is there anyone who has applied since October 2009 that didn't do any meds, xrays?

I was just going to get a headed letter from Stu's boss (he 's sub contracted really) , own ABN etc,stating how long he's been working for him and average weekly hours and use his tax return for showing the work requirement....

Hi,

if possible the letter from Stu's boss should state minimum weekly hours, only weeks when he worked 35 hours or more count, even if on average he worked 35 hours or more, a small detail but may make a difference.

Hi Simon, Good point....We did only count the ones over 35 but would be good to state exactly how many weeks he worked over 35

Do you have any idea of anyone who didn't have to redo the meds, I've known lots in the past but it looks like that there was a new ruling came in October 09 so that we will have to redo them, it would just save on that cost, Cheers, Fiona

if you could email me the stat dec that would be great and I can get a head start on it. I did try to find it on the DIAC website, but could only find spouse/defacto/violence ones and I don't think they quite fit what I am looking for.

Don't do them til asked. We applied in june by paper:arghh: Big mistake!!! Got our 887 the end of october. Medicals were never mentionned. I thought we would have to re do them as hubby got a cat b in his original medical and had to sign a health undertaking that he would go for yearly x-rays. Was never aked. TBH I don't know of anyone who has had to redo them.

The stat decs are needed as extra evidence for those of us who are self employed or business owners as it can be difficult to prove our work hours .

Well we tried to apply online prior to the one month mark and it wouldn't let us go further after we put in our passport number.......so I tried again on 8th Feb, our residency is due to be applied for on 2nd March......it let us put all the information in, pay the $230 fee....we were ecstatic only to receive an email on Thursday telling us that because we have not met the criteria as yet they are either going to cancel the visa or have us withdraw the application.

 

We are not entitled to the $230 refund as it goes by the date you applied, regardless of only having to wait till Tuesday to have met the criteria, we have to withdraw, lose the money and do it again!!!

 

I only hope now that once we apply on Tuesday that they do not require us to re-do police checks and medicals again and cost us more money....so let it be a warning to others, be patient and wait till your time is up, then apply or you could be out of pocket!!

I sent an email and a covering letter to the department off immigration stating my concerns and confusion as to why they would have taken my money had I not met the criteria, so have to await till the offices re-open to get a proper response, but I received this automated e-mail.....I have read it over and over again and now worried that my 496 SIR visa falls into the latter category of not being a priority and being looked at with a view of a decision at the end of 2011!!!

 

Can some of you read this and let me know what you think, otherwise it's going to be a long weekend and I don't think I have enough Aussie wine to see me through!

Changes to Priority Processing – 8 February 2010

Direction No. 45 - Order of consideration - certain skilled migration

visas

 

The Migration Act 1958 contains powers by which the Minister can consider

and finalise visa applications in an order of priority that the Minister

considers appropriate. Departmental officers are required to follow this

Ministerial direction, which applies to every stage of visa processing.

 

The Minister for Immigration and Citizenship, Senator Chris Evans, has set

new processing priorities for certain skilled migration visa applications.

The direction came into effect on 8 February 2010 and applies to new

applications lodged on or after 8 February 2010, and those already lodged

or in the final stages of processing, and replaces the previous Priority

Processing Direction (No. 42) which commenced on 23 September 2009.

 

The new priority processing arrangements apply to the following visa

programs:

· The Employer Nomination Scheme (ENS)

· The Regional Sponsored Migration Scheme (RSMS)

· General Skilled Migration (GSM).

 

Under the ministerial direction, the following processing

priorities (with highest priority listed first) apply:

1. Applications from people who are employer

sponsored under the ENS and the RSMS.

2. Applications from people who are

nominated by a state/territory government agency under a state

migration plan agreed to by the

minister.

3. Applications from people who are

nominated by a state/territory government agency and whose

nominated occupation is on the Critical

Skills List (CSL).

4. Applications from people who are neither

nominated nor sponsored in priority groups 1, 2 or 3, but whose

nominated occupation is listed on the

CSL.

5. Applications from people who are

nominated by a state/territory government agency whose nominated

occupation is not listed on the CSL.

6. (i) Applications from people whose

occupations are listed on the Migration Occupations in Demand List

(MODL).

(ii) Applications from people who are

sponsored by family and whose nominated occupation is not listed

on the CSL.

7. All other applications are to be

processed in the order in which they are received.

More information is available from the Critical Skills List information

sheet.

 

The following GSM visa subclasses are exempt from the priority processing

provisions specified in Direction 45:

· Skilled – Recognised Graduate Subclass 476

· Skilled – Graduate Subclass 485

· Skilled – Designated Area – Sponsored (Residence) Subclass 883

· Skilled – Regional Subclass 887.

 

Applications for these visa subclasses will be processed in the order in

which they are received.

 

The following GSM applications are exempt from Direction 45

 

· applications that have been remitted by the Migration Review Tribunal

for reconsideration;

· applications where it is readily apparent that the criteria for grant

of the visa would not be satisfied;

· applications by members of the family unit of a person who holds a

temporary or provisional GSM visa (subsequent entrant applications).

· visa applications for a Skilled – Regional Sponsored Subclass 487

visa where the applicant holds a Skilled – Independent Regional

(Provisional) Subclass 495 visa, Skilled – Designated Area-sponsored

(Provisional) Subclass 496 visa, Skilled – Regional Sponsored Subclass 487

visa or Skilled – Regional Sponsored Subclass 475 visa at the time they

apply.

 

The CSL is a list of occupations developed in response to the changing

critical skills needs of Australia. The CSL can be found on the

Department of Immigration and Citizenship’s (the Department’s) website at:

*If your application is not currently a priority under the Direction, you

should expect significant delays before your application is allocated to a

case officer. To find out the expected timeframe for processing your

application, please refer to the department’s website at

You will be contacted once your application is allocated to a case

officer. The order in which your application will be assigned to a case

officer will depend on its priority under the Minister’s Processing

Priorities. Please do not contact the Department to request your

application be exempt from the Priority Processing Direction. Case

officers must adhere to the Minister’s Direction.

 

Are you an Accountant (with IELTS 7s) or a Computing Professional with

Specialisation?

 

If you have a skills assessment from Australian Computing Society that

states your nominated occupation as "Computing Professional (ICT Recent

Graduate)" this does not place you on the CSL and you are therefore not

eligible for priority processing at this time.

 

If you are an Accountant with IELTS 7s we would like to hear from you to

ensure we don’t miss your application in the weekly allocations. Once you

have provided all the documents required for a case officer to make a

decision, and if your application has not yet been allocated, please send
