Did not get visa

Hi all

 

We last posted here 3/3/10 saying that we were having problems with our visa well we found out last week we have been refused.

 

This was due to my daughter failing to meet health requirments as she has Dysraxia, she has never been or wanted to come with us, she is staying in the uk with my ex-wife but she had to be put on the application because she was under 18 years old.

 

So Australia rules one fail you all fail ,so after our visit to Adelaide in 2008 were we fell in love with the place we started our dream now it has all been shatered.

 

As it stands it looks like our agent was to blame for this he should have steped in sooner when we were having problems but he left it to us to sort out.

 

We have been posting on poms in oz about this and Gollywobler has been amazing so if any body nows of any way we can maby still live our dream please let us know as time is running out, I will be 45 in April 2011 mybe a sponser would help.

 

I am a carpenter and have all my city and guilds aslo advanced also have passed the vetassess carpentry iii and got the certificate ,and I am blody good at my job as I have been doing it since I left school and worked all over the word but would like to settle in Adelaide.

 

My wife and 3 year old desperatly want to get to Adelaide also.

 

HELP !

Sorry to hear about this, i have read the previous posts on PIO...

 

Can you apply again without the daughter on the application?

 

My Understanding was that you only had to include people if you wanted the right to sponsor them for a visa in the future, they didnt actually have to be included for the full visa. Sorry if this doesnt come across clearly?

 

For example, My parents, My wifes parents and all of our brothers and sisters are named on our application, this is to ensure that in the future before we get citizenship we can sponsor them, but they arent full applicants, only me and my wife are, can you not remove her from the application, or try and lodge another one, after all, like you say she is staying with her mother in the UK

Is the refusal the "final decision" - i.e. have you gone through an appeal process yet?

As you know they balance their interpretation of how much your daughter is likely to cost the health system against what "an average Australian" would cost, including dependancy costs / not being able to work.

If you've still got the appeal up your sleeve, then a specialist report detailing likely prognosis / costs / and ability to work might help. We used (as did many people on the Oz forums) Dr Martha Baz - she's an occupational health specialist.

It always seems rather cruel that they pigeon hole children based on a label before they've had a chance to prove them wrong. I hope something works out for you.

Although she has no intention of moving with you, if anything happened to your ex wife, this would change. My children from my first marriage also had to be on the application as well as have medicals for this very reason.

I'm sure if anyone can find a solution, Gill can. Good luck with it.

Yes this is the final decision we have sent our letter of "natural justice" but they stuck with there first decision.

We do have the chance of a MRT but very costly and been advised not to persue as diac would probabily not change there mind.

i would try appealing the decision not sure if you have a migration agent but if not might be worth contacting one for advice good luck x

We have appealed and we do have an agent but it looks like it was the agents fault ,he should have looked at our case as it was going along but he did not I think and just trusted one of his employees to do it.

G'day guys

 

Looks like we wiil have to re-apply next year when my daughter will be independent, so can I ask you all as a fellow carpenters and scots (sorry) brits, can you ask your employers if they could sponser a realy good carpenter/joiner with many years exspereance starting next year 1/2/11 as my daughter will be 18 and dependent.

This I know as she is going to college in the summer and wiil get a job.

Hi Stuart,

 

Sorry to hear your bad news you must be pretty upset. We used Visa Bureau to get us out here and they were fantastic we only had a short time before my husbands 45th and they rushed us through and were fantastic, maybe they could advise you what to do next.

Get in touch with George lambard you will find him on poms in oz. He has helped people with appeals and won. You will have to pay for his services but he will be able to tell you if you have a chance. You say gill has helped you she will know who he works for. Best of luck.

There is an agent in oz who specifically deals with cases like yours. I think his name is Peter Bollard (not sure if that is his last name) He has helped lots of people on british expats in similiar cases to yours . Go onto www.britishexpats.com and ask. He specialises in visas that could fail due to medical reasons. If he can't help you then no one can .

One you you should look at is a refusal by your ex wife to allow a medical. This is common where ex wife refuses to assist your migration. You will need an audit trail of la etter where she refuses due to a break down of communication. Once you have a letter saying she refuses you should then get a formal letter from your legal person to confirm this. I did this via global visa's and they were very good and had some previous cases as a history of it happening before.

 

Not sure if you can apply again but this may be a way round it for you, this is not an ideal route but one you could look at. This is how I over come the medical test for my daughter who was 17.

If your agent is at fault can you not get some money back?? then use the money to reapply next time??
