sponsered visa about terminate contract

not sure this makes sense. Im not sure if you are here or not but if you are then surely its up to them to provide the evidence to you?

 

if your not here yet - what visa are you planning on getting?

The same rules apply to you as to any other employee, they have to follow the terms in the contract (re notice periods etc) if they're going to fire you/make you redundant. As sponsors for a PR visa, they would just need to show the evidence to DIAC as to why they decided you were unsuitable for the job, for a 457 visa, they probably wouldn't even need to do that.

 

Whether or not you would then be able to keep the visa would depend on which visa it is, the conditions of the visa, and the particulars of the situation... But this part doesn't affect the employer, just you.

However on a 457 visa im led to believe that if they are sponsoring you then whist you remain on that sponsored visa you are their responsibility until you have PR ie they have to fork out the fare home?

thats correct they have to pay your flights home until you move on to another visa - although it doesnt have to be a PR visa it can be any visa

I too am a bit confused about why you are asking this question. If your employer is already sponsoring you they should have all this information already as the employer's obligations as a sponsor are laid out quite clearly in the documents they have to complete to become sponsors in the first place and termination of contract is covered in the supporting information. If you are trying to persuade them to sponsor you and they haven't done this before, to see the obligations in advance of making the decision to become a sponsor they can go to the ENS or RSMS sponsorship pages on the Immi website and download copies of both the forms and the supporting information. As sheila_n says, if they are asking you to provide this info then I'd be a bit worried about their level of commitment, but you can always go on the website and download the documents for them if they can't be bothered to do it themselves.
