sugarboy I am confused about my wife's IELTS in 887 visa. I am on 489 visa now. On the immigration website 886 visa checklist they says secondary applicant over age 18 have to Functional IELTS result. Even in Fees and cost page they have mentioned second instalment of $4,000 roughly have to pay if dependent doesn't have Functional IELTS.
      please refer this immi website:
      http://www.immi.gov.au/Visas/Pages/checklists/887.aspx

please help me in this big confusion regarding my wife need IELTS or not ? I am a main applicant in 887 visa.

      thank You
      Eric Hu
Please find below an extract from Migration Act detailing criteria for secondary applicants of 887 visa:

      887.3—Secondary criteria
Note: These criteria must be satisfied by applicants who are members of the family unit of an applicant who satisfies the primary criteria.
887.31—Criteria to be satisfied at time of application
      887.311
The applicant is a member of the family unit of a person who satisfies the primary criteria in Subdivision 887.21 and made a combined application with that person.
887.32—Criteria to be satisfied at time of decision
      887.321
The applicant continues to be a member of the family unit of a person who, having satisfied the primary criteria, is the holder of a Subclass 887 visa.
      887.322
      The applicant:
      (a) satisfies public interest criteria 4001, 4002, 4003, 4004, 4007, 4010, 4020 and 4021; and
      (b) if the applicant had turned 18 at the time of application—satisfies public interest criterion 4019.
      887.323
The applicant satisfies special return criteria 5001, 5002 and 5010.
      887.324
If the applicant is less than 18, public interest criteria 4017 and 4018 are satisfied in relation to the applicant.

Ok, so nowhere above it says that the secondary applicant must meet functional English requirement. But yes, I do see that they have that written on their checklist at immi.gov.au. I guess its best if you send an email to gsm.adelaide@immi.gov.au for further confirmation. This way you have what they want from you in writing as well.

      Hi

I will be applying for 887 Visa soon,
Can I move to another state in regional area while my visa is being processed,
I understand that after 887 is approved, I can live anywhere.
I have lived in my nominated state for 2years working full time on 489 visa.

Any answers will be greatly appreciated.

      Thanks

As far as I know if the visa doesn't have condition to live in a certain state you were free to go to any state's regional area from the beginning.

There are 2 conditions, please consider the below:

      1. If you stay on your 489 during the time your 887 is processed then you cannot move outside of the regional area.
      2. If you move onto Bridging Visa A as a result of your 489 expiring, then it depends on the conditions of your Bridging visa. You can check your visa conditions at: https://online.immi.gov.au/evo/first...tionType=query

      Hope this helps.

The question is moving to another regional area so I think he was free to go to any regional area from the beginning.

I had signed an agreement saying "I will live and work in my nominated occupation or closely related occupation in NT for 2 years after my visa 489 is approved"
Its 190 where you can move anywhere from the start.
      Thanks.

      Hi sugarboy againstthewind Eric,

First of all thanks all for your reply,

againstthwind : Before my 489 was approved I signed an agreement with state that I will be living in that state and working full time in nominated occupation or closely related occupation for at-least 2 years."
Now, to be eligible for 887 visa I must satisfy conditions outlined by my sponsoring state, which I did.

Now, I am eligible for 887 visa. But my question remains, can I change my state now and live in regional area only while my 887 visa is being processed.

Sugarboy : I still have 2 more years on 489 visa so expiry is not an issue. I also understand that I have to abide my 489 visa untill 887 is approved, which has condition to live and work in regional area, so after 2 years can it be any regional area or regional area of state that sponsored untill 887 approval.

This is my first post on this thread I was glad to see all your replies. I will stick to this thread and share information as well.

      Much Thanks everyone,
