Question Re Bridging visas.....

Morning People!

 

Ok quick question, having a debate here that needs settling!

 

If someone is on a 457 visa and then applys for a Tempory Residence Transition 187, do they

 

a) go on to a bridging visa as soon as their application is recieved.....or...

 

b) remain on their 457 visa until it expires and only be put on to a bridging visa should the 457 expire before 187 is granted

 

????

They are issued the bridging visa straight away, but it doesn't kick in until the 457 expires.

A Bridging Visa is issued in the circumstances described, but only "comes into effect" upon the expiry of the 457 visa if a decision to grant the 187 visa has not been made by that date.

So, if the 187 is granted before the 457 runs out they have never actually used the bridging visa. Also, the bridging visa only kicks in if the 457 expires, not if it is cancelled.

 

If the holder travels abroad and returns to Australia on the 457 this will 'kill' the bridging visa even if it has not been activated. If the 457 expires before another visa is granted the (non) visa holder would become an unauthorised non citizen. In these circumstances the DIAC, upon application, would usually reinstate a bridging A without a fuss. The same applies to 485 and other visa holders who think can come and go as they please and have been so advised by posts on this forum.

 

It is possibly worth noting that an application for citizenship must fail the the applicant was 'illegal' at any time during the residence qualifying period.

If we travel on BVB, do we have to reinstate the BVA upon returning back?

No, it automatically reverts back to bridging visa a after three months as long as you are in Australia.
