Anyone ever cancelled a visa???

Hi all this may seem an odd question but as anyone out there ever cancelled a visa and if so did you receive a refund. We submitted application April 17th but have not scanned any docs through yet as still waiting for paperwork from ex. We emailed diac and they say we need to fax cancellation through but are not guaranteed a refund which seems abit unfair as they won't even look at the application for some time . The only way I can think round this is to not submit anything and then the application would be rejected thus a refund given.

 

Sorry if this not the sort of post people want to read but I could do with some help on this one

The only person I know that cancelled a visa was Sarah (aussiebound) if you go to her profile you should be able to email her from there.

 

Does this mean you aren't going to be joining us in Oz???

I did try to withdraw our visa application but we had got as far as just waiting for the go ahead for Medicals to be done and police checks!I was under so much pressure and emotional blackmail at the time that i crumbled and decided having got that far i couldn't go through with it!Long story!!!

Notified our agent who thankfully gave me time to gather myself together and didn't withdraw anything incase i regretted doing so!A few months later we got back on track,had medicals done ans sent police checks off and are now just sitting tight for the visa!We would not have got any money back i was told at that stage all we would have saved on was paying out for medicals and police checks!But you are not this far!

I could ask my agent if you like!He is fab and e mails me all the time!Answers any questions i ask straight away!

 

I take it you may not be going to oz now?

Anyway as we are 5 points short hubby thinks he may sit the ielts test as alot seem to be doing that but to be honest we just haven't felt the same over these last few weeks about emigrating. Call it what you will Is it cos its summer here ?, is it because we think we may have missed the boat financially what with the current hosing market etc. To be honest we're sick of wondering if we're doing the right thing and as in the words of John Lennon ' life is what happens while you're busy making other plans' I'm getting sick of making other plans I just want my life which to be honest isn't a bad one at all

I'm sorry to hear you've changed your minds, thought we hadn't heard from you on here in a while - you will be very missed on this site too. I too have days when I wonder why we're doing it, and if we've got caught up in it all..but have decided to give it a go and see what happens. I know what you mean about the weather too - while it's sunny here it doesn't seem too bad, but I just can't bear the thought of another cold and damp winter here.

 

As you know, we too are going on the 475 visa - can i ask what worries you've had about this visa recently? Now I'm worried???!

 

Do you think it might be worthing pursuing with it if you can't get your money back incase you change your minds?

We did - long story over sponsership to Victoria a while back. Unfortuately we were told as soon as the money is taken out - it's non refunable - no exceptions!

Sorry - I'm sure that's what you don't want to hear.

Was a very expensive lesson for us!

Please don't let me put any doubts in your head espeicially re the sir 475 its a way into Australia and for many is the only way I personally would feel better going on the permanent one mainly for financial reasons as we have 3 children but I am certainly not putting this visa down. Thanks also for saying I would be missed on this site I was a bit choked when I read that cos it will be quite a wrench leaving you all as I feel to know alot of you by now. I will pop in though to see how you all are getting on as regards letting the application go through thats another good point as we may feel differently but as I said I'm getting sick of wondering whether its the right thing.

 

Thanks anyway and if anyone can advise on the refund issue that would be good

Pete as you know we have been very undecided over last few weeks alot stemmed from the temp visa we are going on.

 

It is a decission only you can make. I do know your doubts but there must be reasons why you decided to go for the visa in the first place. I'm sure you have weighed it all up. The other thing is the Adelaide thing. Would the english test give you PR? If I remember correctly you could get a PR visa in all/most of the other states but Adelaide is where you want to be. If I was in your shoes I would also be considering going to the Melbourne area until I could gain citizenship and then move to SA. I'm sure you have covered all angles and I hope you make the right decission for you and your family.

My advice (if you decide to cancel) is not to be turned down through lack of supporting evidence. A few years down the line you may change your mind and go for it. If so the fact the a visa was refused in the past will count against you. Tell them you are withdrawing your application in writing and keep a copy.

 

You never know.

I totally sympathize and understand what you are saying!We too are going on the 3 year temp SIR visa (so wish it could be permanent but have been shot down once before on here for being "ungrateful" about our temp way in!!!!!)

 

But like you i wonder are we doing the right thing and with 4 young kids and NO job lined up for hubby and giving up the security of our life here (which isn't so bad)is bloody terrifying!!!!!

 

Most of our family and friends think we are crazy and keep telling us we are just looking for some excitment in our lives as we are going through a mid life crisis!!They are holding bets how long it will be until we are back in the UK (Which i don't find very amusing)

Hi Pete thanks for the advise. Yes it is frustrating that in almost all the other states we would have got a perm visa but we do like the sound of Adelaide and once we gain PR can go anywhere in Oz now they've changed the regulations. I've checked on the DIAC website and it does state it is a non-refundable fee so I'm going to let the application go through and forget about it for a while until we are required to have meds/pc's and like people say we may feel differently espeicially when the darkness descents in winter for 6 months. Oh dear I wish sometimes they'd just put a stop to all applications by dizzy brunettes called Jill Wright (apologies to any fellow brunette namesakes out there)

My agent just replied and in answer to your question regarding possible refund his answer was "IT WOULD BE EASIER EXTRACTING TEETH FROM YOURSELF THAN GETTING A REFUND FROM DIAC"

Yes it does Gill cos its made our minds up regarding trying to make up the necessary points and apply for the PR visa instead we can't afford to shell out any more money. We'll stick with this and let it ride cos its a definate rollercoaster we're on and we may as well continue with it, its abit soon to get off

Jill , I think thats the right choice , you have come too far now to back out , some time ago someone pulled out and cancelled their meds after the visa was issued although I respect their decesion but I think they will forever ask "what if" . Good choice and go for it.

Hi Jill,

 

I know what you mean about housing market etc... but the process is so long, its worth just riding it out and seeing what position you are in at the end when you get the visa, only then will you know whether things are right. Hey, you never know, by the time your visa is granted your house maybe worth 4.5 million and the exchange rate might be $24562.05 to the pound!!!

 

just let it ride its course. its a long wait anyways.

Couldn't agree with you more!

Although many of us have not even met yet it is so nice to have this circle of lovely people (well most of you!!!!)that are there to reassure,help,advise and chat the drop of a hat!!

 

There have been many times i have been very down,wobbly,unsure and scared and after getting messages back or just sitting reading different threads i soon feel top of the world again!

 

So like the other jill says - thanks guys and whoever thought of setting this site us is a godsend!

How the hell would some of us manage without it!

I'm glad you have decided to stick with it. A hard decision knowing what to do fo rthe best. At the end of the day (and I will probably be shot down for saying this!!) you can always come back if you don't like it. At the end of the day it is your life and if you don go and decide to come back you have not wasted that visa money, you can say been there done that decided to come back. You will at least not live with the 'what ifs' for the rest of your life. Good luck and hope you are feeling more positive soon

Wow,

I feel for you here. Sit back have a glass of South Australian Wine then sit and watch the news on TV this evening. Maybe just maybe you will start shouting at the TV and gain that Aussie feeling back.

Hang on in there, don't cancel anything just relax and get on with your life. When the request finally comes through for Medicals etc you may well have changed your minds again. Have the Medicals done (Start Saving Now so you won't miss the money when it it happens)

Then sit back again and wait, get on with life and then Hey Presto Visa arrives. You can now make a decision. Don't worry about it being a 475 Visa! It's still a Visa and to gain permanency isn't really that hard after-wards.

Like you we have a very good life here, good jobs which we will give up, three boys that we are leaving behind!

If we don't go for it now we miss the boat due to age and will always wonder what if.

You, like us have come along way, see the final bit out before you make a decision you may regret later.

It's your decision but don't make the wrong one!

Like others have said stick with it until the next round of expense is due and then see how you feel, sometimes when things seem to be going against you, it is easy to make a snap decision which you later regret, stay positive and focused and things will happen,

Sorry for taking so long to reply, don't check into the site very much anymore. We did apply to cancel our visa last October / november time. It was finally cancelled and we received notification of this two weeks ago! Up to that time we could have changed our minds and gone, and there was several times when we actually thought about it! We never received any refund, as has previously been said, once its out of the bank its gone! I think you are doing the right thing, they have your money, if you start the cancellation process you may change your mind before medicals are requested. Our medicals had to be done my the middle of march, DIAC was still giving us extra time right up until middle of May. We had to write 3 emails and 2 letters to finally get the application cancelled. Definitely stick with it for now, you have nothing to lose! Whatever you do choose, do NOT just ignore info requests etc etc as you will have the visa cancelled by DIAC and if you choose to even visit the country on holiday in the future, you will struggle to gain a visa of any sort as you will have a refusal with your name!!!!

 

We chose to stay in England, for us it was the wrong time in our lives, but we will always wonder if we did the right thing, or took the cowards / easy option! Who knows! Good luck with whatever decision you take.

 

Sorry for rabbling on, people of old will be used to it!
