Hey guys,

 

Can anyone give any advise on breaking your lease? What you have to do or pay etc? We are aware every agent is different, we are with Key Rentals, any advise would be very much appreciated :cute:

Interestingly the Office of Consumer and Business Affairs (OCBA) Website says that "Under a fixed term agreement a tenant cannot give valid notice of his or her intention to vacate prior to the final day of the term. The fixed term is binding. The tenancy can be terminated early if the landlord consents to the tenant vacating and waives liability." It can apparently be done if the landlord agrees but you are liable for the rent until it becomes leased (up until your agreement would normally finish) - also you would be liable for pro rata costs of advertising so if you only had one month left to go it is worked out as 1/12 of advertising costs. Check out the link OCBA - Termination by tenant A lot of people seem to do it but I guess it is up to the landlords discretion.
