Landlord's Obligations

Hi

 

Can anyone tell us if there is any way we can enforce our landlord to secure the boundary to our garden by putting up a fence around the edge of our garden. There is an appx 3 ft drop all around the back garden which we did not notice on first inspection nor was this pointed out to us. Our children are old enough to hopefully, be aware of it, but concerned for others that may visit.

If you have asked the landlord or agent and they have said "no they don't have plans to put a fence up" then contact the http://www.ocba.sa.gov.au/ (tenancies section) and ask for their advice. It definitely sounds like someone could fall and so is a safety issue.

We had a similar problem where the fence was not finished and agin didnt notice on first inspection,we approached the agent and the landlord came out to see us and just told us out straight he didnt have the money to do it...maybe next year?? Huge problem for us cos our little girl can get out so cant let her play out the back garden unless we are sitting there...and my point was if she can get out people can get in!!! But no joy so far....moving out in 5 weeks!
