I called immi and they told me that we are free to go once you are on bridging visa.

Even though Call center is official source, it provides general information on visa and related issues (Recorded Disclaimer is provided at the start of the call)  This is a specific question cannot rely on the information received from the call center to make decisions. It is advisable to have it in writing from the relevant department if anyone wants to make a decision relating to any move.

    Hi Helpful Group Members,

I needed to ask this question:

While on visa 489 i was not allowed to live and work in Sydney, NSW. Now i have applied for my PR on 19 April 2019 and currently on Bridging Visa B. I want to confirm does the designated areas living condition continue on bridging visa B as well or can i move to Sydney if needed. There are no conditions mentioned on BVB that was given to me.

Should i consider that since no condition is mentioned on BVB so i can move or the conditions of 489 will implicitly be on BVB as well untill we are granted 887?

    Regards

    MM

To answer your question based on the "limited information available", you cannot stay outside regional areas till your 887 visa is processed.

Having said that, I have tried to relate this legally, as per the act/legislation/policies  the bridging visa is issued against the visa one applies for and conditions will apply as per that. In this case it is 887 which is a Permanent Residency visa which does not have any conditions.

Legally speaking based on the visa you have one needs to be in compliance with that , the bridging visa states that there are no conditions which means at any time the applicant will be in compliance of visa conditions even though he is not in regional area.

Given the limitation on the information available, it will be highly difficult for anyone in this group  to 100% tell that it can be possible based on factual evidence. Conservative approach is to continue and stick to regional areas.

If your circumstances are really trying the best option is to discuss with the immigration and work out a way. There is always a solution if one is ready to look for and invest time in finding one.

Immigration website is silent on this for obvious reasons.

    Hope this gives some insight.

How do we know the number of files in subsequent months ? Also one of my friends about to lodge 887 and her agent gave her the documents stating the processing time 9-15 months. Not sure if it’s the outdated one?

Tracker maintained in this forum is one way.. though it will not cover 100% population of  all the applicants. Can give some indication/correlation  to the processing timeline.

Best source will be the department under FOI -  Freedom of Information to get accurate details of total number for applicants.

Not sure how did agent come up with 9-15 months.. as of now it is 18 months for 90% of the application as per the website. Lets c what's the update in January should happen sometime soon.

    Congratulations mate

    Time to open December now

Sent from my iPhone using Tapatalk

Looks like the processing time will be going down further.. they are already into November now.. December 18 we have less applications as compared to previous months soon they would start with January 19.

It will be beneficial for  all December 18 to March 19 applicants to review and check their documentation to avoid any unwanted delays or query.

Progressing well.. Best wishes to everyone.

    Guys I need a help:-

Filling 887 application online. and there is a section to provide address details:-

Provide details of all countries in which you, your spouse/de facto partner or dependents (accompanying or not) have lived for 12 months or more (since turning 16) during the last 10 years.

Do we have to provide address details of parents/Siblings ? Also they are not included in the visa application

    1. Only you, your spouse/de facto partner or dependents  of the current application.

    2. Parents/Siblings details are to be  provided in questions 44 and 45 respectively.

To ALL whom are above the 12 months waiting period.

I'm reposting my post above from last week.

Altough I already have received my PR, I do believe it will be of great help if you write Shamsher your story.

TAKE ACTION - If you have complied to your visa conditions - have NO FEAR of getting your story published in the news.

    Good luck!

    Thanks Stellajane, Much appreciated.

All - Please share stories, where it can count and make difference.

This forum can help all, but cannot get directly reach out to authorities.

The hard work previously done is showing results,  where the media is proactively wanting to cover the stories. So please act if you are struggling with the processing timelines.

    Hi Dee,

We were told by immigration if we evacuate or relocate we need to contact immigration as we do not fulfil our criteria to live in a  designated area.

And this could effect our visa.

I don't think it will be case, It is a national emergency and been safe is utmost priority and rest of the things are secondary to it. looks like you have spoken at contact center, who would have just provided you a standard response.

The situation is not within your control and it is as directed by the authorities and hence you will be fine. You can write to them stating your situation, given the timeline of responses, cannot see  a response coming through  in a swift manner. Still you should write to them and make it official.

But also remember evacuation will basically done on threat level and if it goes down you will need to return where you reside currently( which you would). As moving then will not be justified.

It is a  wait, watch and act situation. Be safe.

    Need some information:-

I stayed with a friend on mine for few weeks while coming to Australia.

Now I am ready to apply for 887 and looking a letter certified from JP that I stayed with my friend. Will both be required in front of JP to get that letter of he only can get that letter for me?

Is this certificate really required or other proofs can do?

Not required really.. you can mention it in your summary document  that you have stayed for initial  4 weeks in your friends house providing his contact details.

It is reasonable and very much practical to understand  that applicants coming new to the country,  will have some sort of temporary arrangements for accommodation,it could be hotel/air bnb/relative's or friends house etc.

so do not fuss much on this. As long as you have your accommodation papers in order where you have resided post the temporary stay.

    ACTION REQUIRED FROM ALL US

NEW SBS NEWS ARTICLE IN THE PIPELINE

Hi guys, last August-September 2019 we - as the 887 community on this forum - experienced some true struggles as the DHA was increasing the processing times over and over again. At that given point it was up to 23-24 months processing times.

Really happy to see that they have decreased the processing times now, but still they are a loooong wait if you're waiting on your grant to further built up your life.

On this forum a few people organised some media attention and a few articles were published on SBS Punjabi. And with some success!

My personal story was published also within one of those articles and YES we did receive our direct grant on 11/11/19. I do believe that the media attention did trigger something with DHA as a lot of 887 applicants did receive an additional email stating that their case was going to be assessed soon.

Anyway... media attention is great to address the never ending limbo 887 applicants are in. DHA should decrease the processing times to at least an appropriate level as we all have been in the country for 2 years already.

Mr. Shamsher Kainth from SBS Punjabi contacted me today again to follow up on my case and requesting if I did receive my grant, hence that he is ON the case and that he does care.

HE WANTS TO WRITE A NEW ARTICLE FOR SBS REGARDING THE STRUGGLES WE'RE FACING WHILST WAITING FOR OUR PR.

    his email address: shamsher.kainth@sbs.com.au

He needs to have information from you!

Please write him a letter to describe what your struggles are, why your case seems to be delayed (asking for additional paperwork whilst already provided, not getting the information for the baby medicals on time, not getting another job application because you're temporary, al those things,..), what you want from DHA (more clear information regarding processing times, better communication,...) and what you reckon could improve.

Grab this opportunity with both hands. Every media attention that you can have is great.

    Cheers,

    Stellajane.

    @TTTF@Dee@nudgee@Megrand1@TakeItOnTheChin@887 2019@Skaur@SUDIP@Hope

That's good news... Applicants who are waiting long should share the stories to address the issues. Specially those who are 12+ months.

These periodic news articles, will make a difference in long run to bring down the processing time.  As there are many applicants waiting to get over the line.

All these efforts count for everyone. Keep Contributing to the larger benefit of the group.

Thanks @Stellajane for sharing the info. Much appreciated.

    I hope the stats helps.

I think they should be publishing this data on a monthly basis to keep the process transparent ..  without a need of FOI.

    • 90% of applications: 18 months

We are currently assessing applications submitted before November 2018

Great news.. by mid next year it will be back to the normal 6/7 months..

The efforts put in is showing results, not discounting to the fact that number of applications have gone down.

LETTER TO THE ADDRESS PROCESSING DELAYS FOR 887 VISA

TO: Hon Scott Morrison MP, Prime Minister

Hon Peter Dutton MP, Minister for Home Affairs

Hon David Coleman MP, Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs

    RE: 887 Visa Processing Delays

    PURPOSE

Response and solution from Department of Home Affairs to the address the processing delays for 887 Permanent Visa.

    DISCUSSION

As an introduction, we are a group (900 plus members) 489 (Regional Skilled Visa) applicants spread across the regional area of the country who have applied 887 visa (Permanent visa) in the years 2017/18 & 19 (Approx. 4000 PR visa applications).

We wanted to get in touch with you regarding the delays faced in processing of the permanent visas (sub class 887), which in turn is having significant impact on our day to day life.

During the time of the 489 application the processing timeline stated  for 887 visa post completion of compliance to the 489 visa conditions was anywhere between 7 to 8 months. It has now increased almost 3 folds and currently is anywhere between 21 to 23 months as per the information available on the IMMI website.

We do appreciate that during this time there has been increase in the visa applications and all the visa cases are to be dealt individually due to which time line can vary on case to case basis. Given the fact that current process does permit applications to be decision ready. Having said that, what is the department planning to address this issue and taking into account that all the related employment and regional stay has been within the country the verification process can be much faster as compared to an offshore application.

The impact it is having on the applicants and their family members is substantial, as the applicants and their family members face struggle, discrimination, eligibility questions in various walks of life due to this delay.

Overview of the issue in daily life,

    1.    Many of the applicants are on contract employment and the companies find it difficult to extend the contracts since our visa status is not clear.

    2.    If the applicants try to apply new employment roles, they find them not eligible since they do not hold a valid residency status, even though they have full working rights as per immigration department. Most of the companies do not find it difficult to understand and it is very tedious task to make them understand and mostly end up losing out on the employment opportunity in this process.

    3.    When these applicants go to enroll for utility services such as a basic phone contract they find themselves as not being eligible for it due to visa constraints.

    4.    Many of the family members struggle in educational sector since they do not have permanent residency to be eligible for educational cover for the young children.

    5.    Some even face issues in extending their house leases due to the visa status as most agents demand the visa copy and bridging visa puts question mark on their housing applications.

    6.    Cannot invest in housing market, since they do not hold permanent residency

    7.    Financial services are mostly out of reach as banks do not consider such applicants where the PR is still in processing.

    8.    Cannot plan any future travel or go out of the country as it will result in further delays.

    9.    Have to apply police clearance (the current AFP clearance is valid only for 12 months) multiple times as the one submitted at the time of application does not stand valid in this lengthy processing time, which adds up to the cost as a family and results in further delays.

They are even many other unique and harsh situation faced by the applicants in their daily life.

All this anguish even after been in compliance to all the visa conditions and doing the hard yards of regional struggle. All these applicants have supported the regional economy across the country in all possible ways contributing towards the economic growth and would want to continue to do so.

    What we expect,

    1.    Lesser processing time of applications  around 7/8 months of PR processing

    2.    Clear and transparent information about the status of the processing of applications, with clear numbers of visa applications lodged, In processing and finalized on a monthly basis along with the total cap for 887 visa to be issued by the department on an annual basis

    3.    A decision ready application process

All these visa applicants have done everything to support themselves and contribute to the regional economy on their own without any government support

The only thing we request is for the processing timeline to be reduced and clearing of applications in a swift manner.

Many applicants out there want to continue living in the regional space and contribute to the economy.

With the introduction of new regional visa 491 effective from November 2019, it will create two classes of visa holders in regional space.

    1.    A set of applicants who have struggled and worked their way through the process to find themselves stuck again in the bureaucratic processing delays.

    2.    The second set would be the new regional visa holders in a much secured position with dedicated government support to achieve their objectives.

    3.    We do not envy the situation and are actually glad that government has recognized the need to support people in regional areas as we understand the struggle one has to go through in a space with limited opportunities, but at the same time it should not be disregarded that applicants who have independently achieved and complied with all the conditions and supported the government objective to support and uplift regional economic.

We request your urgent attention to this matter and look forward to see solution to address this issue faced by many applicants across the regional space.

    Response Requested

Your response is requested on the below,

    1.    What is the departmental plan to address increase and clear the 887 visa applications?

    2.    What will be the time frame to resolve the processing delays?

    3.    Processing period from the date of 489 application to 887 grant date be considered as permanent residency, allowing this applicants not to wait another year again to apply citizenship?

    Thanking you,

    Team 887 applicants

    @TTTF   Thanks again mate.Salute!

I think this is another lollipop. They've picked one application from Oct so they can claim they are processing pre-November applications.

My question is simple, have they given grants to June, July, August, Sept applicants?

It is easy to be cynical on this , but the reality as of today also is applicants who have got things in order and right paper work are getting the direct grant with 12 to 15 months irrespective of the processing time lines.

If applicants understand this and proactively submits any potential documents that could be requested, it might help to stop raising these questions.

    Visa application processing times

Last updated: 20 November 2019 (for month ending 31 October 2019)

    887 - Skilled-Regional (subclass 887)   19 months 20 months

We are currently assessing applications submitted before November 2018

They are starting working now, from Sep's applications.

This is going as predicted.. as the number of applications are going down the processing time will get reduced. This is good news in long term.

Feel sorry for the people who are being contacted and no action after that... but think it should be resolved in next 2/3 months considering way things are going.  Stay hopeful.

    Hello all,

I am new to this forum.

I am preparing my 887 visa application and it's due on 3 Dec 2019. I have spent 90 days in the USA for work. Now I am wondering do I need to stay back 90 days or work-related travel consider in total stay requirement?

I am working for USA based MNC and based in Melbourne, and they sent me for work there. I am living in Melbourne since 2015 and I got family sponsor 489 visa on 4 Dec 2017, and as per the condition I can choose to live anywhere in Victoria.

Your advice will be highly appreciated.

    Thank you in advance.

    Cheers,

    Sachin

Conservative approach.. wait for 90 days and apply.

But as per legislation there is no definition around work travel, as long as you have maintained your residency and work  in a regional area it is ok during that period (2 years). It all depends on how strong is your paper work and view case officer takes on your application. It can go either way, no one can guarantee.

Individual will have no control when he or she works for the organisation since as per employment contract one will be required to work as per the location of the client/organisation requirements . Any such travel will be based on organisational requirements and should/will not be considered as breach of the visa condition as it is not employee driven.

It could only raise more questions and add more paper work to application and hence better to wait for 90 days and apply. Hope that makes sense to your situation.

I believe that before 16th November there was already slight difference within eligible postcodes for designated area (when family sponsored) and metropolitan areas (when state sponsored). Maybe we need a family sponsored person on this forum to check with their migration agent?

May be.. but I doubt if anything will impact or change any 489 requirements for eligible postcodes.

All this basically creates two classes of regional visa holders.

Guys, there are 2 different links to the postcode topic on de DHA website. Did I understand it right that family sponsored 489's and their from there 887 applicants do have access to the new eligible postcodes?

Link 1 is for the family sponsored 489's and from there the 887 applicants.

Link 2 is for the state sponsored 489's and from there the 887 applicants.

Don't think there is any change for existing 489 holders or who have applied 887. Things remain same.
