Wills...

    Can anyone recommend a good Aussie solicitor who writes wills? We are in the process of purchasing our first Aussie home and feel we must do this asap.

    Can't help with the question but here's another one about wills. We have a UK will done, does anybody know if it will still be in effect in Australia or willwe have to get a new one done?

    You need a Conveyancer.

    They specialise in property/business transfers.

     

    Dale from dale&jo on here is a Conveyancer from Morphett Vale Conveyancers - nice bloke.

     

    The firm we've used previously is Properte Conveyancers on Beach Road ,Christies Beach.

    Personally I'd get another up to date will done here,not sure of the legal implications of a UK will but best be sure your wishes would be carried out here.It may just protect your family from Inheritance Tax Issues from the UK.

     

    BTW - the grave robbing tax of IHT does not exist here.

    I know it's been ages since I posted my 'wills' thread on PIA but now that we have finalised our house purchase thought it was about time I pulled my finger out with regard to sorting some out. Thanks for your response by the way...Yesterday I almost bought the wills package you suggested but then alarm bells went off...do you have to be a permanent resident to fill one out or can anyone have one? We are on the SIR 495 provisional visa and are not sure of the pros and cons of this sort of will. Any more help would be great...What do you do once you've filled out all the docs? Do you have to lodge it with a solicitor?

    It should be just a few hundred - we had one drawn up years ago here.

    Copy lodged with solicitor and one copy here in our tin box of essential documents.

    I think that's up to you really

    If you need to leave a copy with someone trusted in the UK - why not?

    No legal obligation though.

    The will here is drawn up under Australian law.

    If you are choosing an executor it is best to ask if they would be OK about taking on this task (god forbid).It is quite a task I can assure you.

    Just something to bear in mind on the DIY Will kits. I was at a presentation recently and a lawyer had a slot around Wills etc.

     

    He said that almost half of the DIY Wills done end up having complications and subsequently having to use a Solicitor/Lawyer to get involved. Costing $$$$$

     

    Probably worth seeing a Lawyer to get it done right.
