Still a lot, they haven't finished November yet. I know few of them waiting from September, October also from June & July as well. Looks like, they messed up quite well, they need to short this up before they open up new file.

You can contact me on 07 5493 5556 or andrew.wallace.mp@aph.gov.au.

My office and I can provide help with the following information and issues:

DEALING WITH GOVERNMENT AGENCIES & MINISTERS

If you are having a problem dealing with a Federal Government agency like Centrelink or the NBN, or are struggling for example with an immigration issue, we can help you by raising your case with the relevant authorities. This may take the form of following up with the agency itself or contacting a Federal Minister directly on your behalf.

If you are having this kind of issue I want to hear from you on 07 5493 5556.

I think we should write to

Honourable Andrew Wallace, MP

Federal Member

About the issue, in my opinion not everyone just people who have been waiting longer than 19 months stating how these changes are affecting our life.

Even you try to contact with local MP it's absolutely nothing. They can't help if you are under processing time frame. One of my friends tried this and he showed me the email he received from the MP office.

What we can do, "nothing". Hopefully, upload all the documents and hope for the best.

I am frustrated not because of processing time, because of their way of work. I partially agree with the other guy, we all know there are so many issues going on. In terms of natural disasters, we have nothing to do. Case officers are human too, they need to take their leave, enjoy all the events no problem with that.

My one question will be for them, "when do they work?". They don't work most of the year, does it make any sense? We are still an applicant, just because we applied for a different subclass we have to suffer a lot. Sorry, I can't agree with this logic. I still remember last year, September to December we have been waiting every single day for a grant. There was no issue at that time, they did not process many files. They make their workload heavier and keep us suffer. In terms of bushfire, if someone living in Australia for a quite long time, they will know its happen most of the year. The other issue is, when we got our 489 in 2016 or before, immigration knew it, most of those people gonna apply within two years timeframe. They should have made some plan for the future, as of today I think they had no plan for this situation. 489/887 is not an issue, my friends whoever applied before, got their grant within 6-12 months timeframe. I think we all applied in a bad time when immigration has no time to look after 887 applicants. Hopefully, things will get better in some days but don't know when.

Ok I see your points. But, have you ever tried doing legal action against them? So what are your suggestions? It's easy to say 'oh this is not a good idea, this is not going to work  blah blah blah...'

Are you 100 percent sure we will not going to win???

You basically speak the same as the department, 'JUST WAIT' from my view.

What about this?

Joshua, please read my post again. Of course I have not got experience in taking legal action, I gave you an opinion. Nobody is breaking the law mate

I am following this forum from last year jan vn I applied for my 887. The funny part of this forum when some one come with some solution to take legal action or approach lawyers or some one told we should all protest in front of assembly to make things moving. Always some one come with all knowledge and finish topic. In simple words immigration is responsible for our mental state of mind and stress. Other hand there is no comparison between 189 and 190 as they come out of quota. We already done 489 so we are here to full fill our condition of living and working so we done with that. The 887 can be done with in 6 months if immi wants but they want to bury us in regional area till we die.
They are many people in forum including me too contribute and pay the fee to lawyers to discuss this issue. And guys who applied in last six month don’t think it’s not ur issue . If we don’t act collectively it will increase to 24 months. If we act by our own we can’t do any thing but collectively can change scenario . Thanks

You obviously never read my post properly or cannot interpret it.

It’s very unfair how immigration is processing file people who applied in 2018 June are still in the waiting game and when we applied the processing time frame was 14 to 16 months.

When individual applied for visa the processing times shows specifically 14  to 16 months then we set our goal, we plan our life ahead as the processing time. And all of a sudden after a few months processing time changes 20 - 22 months that shouldn't affect the old applicant.

As per my view if Home Affairs is going to get rid of 887 visas after few months that do not mean we will get affected coz we have already applied, likewise why the hell all applicant is being affected by the changes in processing time than.

The people who have applied before the new changes, shouldn’t be affected by new changes. How fair will be this to all applicant will have some peace of mind.

And once we get contacted by Co's for further documentation why can’t it be finalised in months or two months but no they will ask u again more document after 3 months just to keep us shut and the document they ask is like complete gibberish.

I think we should group up and contact Slater + Gordon Lawyers and tell them how these changes are significantly affecting our life.

These changes are very unethical and regarding the due date at least finalise the case in given due date.

I am happy to contribute let's contact Slater + Gordon.

All,

I have noticed quite a bit of emotional reaction due to lengthy processing times. This is understandable and no doubt everyone has their own frustrations created by their own individual circumstances. Some of our circumstances may be more urgent than others. I have noticed that these emotions have also suggested getting legal assistance. My limited knowledge tells me that this will not provide any resolution because quite simply no law or legislation has been broken and the department are within their rights. Be careful of advice that you may get. No lawyer as far as I am aware has put up a case against the department due to lengthy processing times?

Secondly the processing times of 19 to 22 months is the current measurement of how applications have been processed, not the future. In my opinion 75% is processed within 19 months. 'Within' means before and up to 19 months, that is why there are applicants receiving grants in a 13 to 15 month periods. Another 15% will take longer because they are complicated, and then another 10% beyond 22 months due to further complications, lack of documents, etc

I have also noticed comments that compare the grants of 887 visas to other visa types such as sc190. This is not a good comparison (not apples to apples).Someone indicated that some applicants for the 190's are getting grants after 2 months, which is not a true picture and not an indication of the total period from start of EOI, to invitation, to grant, - it is much longer than 2 months and in most cases longer than a year. Probably similar to when we were granted our 489's for instance. Secondly new 189 and 190 applicants need beyond 80 and even 90 points in some cases, in our day it was only 60 points. Therefore we might not have made it to Oz if we were applying today. Another issue is that we are already in Australia and therefore not priority processing.

I know what I have said does not solve your frustrations but you need to put things into perspective. It is not easy getting to Oz.Also do not assume that CO's are purposely delaying grants, that cannot be the case. There must be circumstances that they are dealing with, for instance the administration of the visas on hold due to coronavirus, etc. I am only guessing, I do not know but I am sure that there is a reason.

If you feel you need to speak to someone then try your local federal MP for instance

My own feelings are that this will not last, I hope. But it is not the end of the world

I appreciate you writing a very suggestive post. However, I don't agree with you on most of the points you've raised.

First of all, In Australia, you can take legal action almost about everything. For example, If you're being bullied in office, you can approach work right commission and if not being heard you can take legal action against both work right commission and your organisation. As per my last conversation with a lawyer (Whos name I don't want to disclose), people have already filed cases against the department about the lengthy processing time (not 887).

In regards to the processing time, yes It could be due to not providing enough documents. However, it is not related to the complication. For example, I landed in Adelaide, stayed for more than two years and worked for 2 years on a full-time role. Filed all tax returns and was never involved in a criminal act. How long do they need to find out these facts considering I've provided all the documents. I was contacted once after I requested to generate the HAPID for my newborn. Just because someone is happened to be in 15 + 10% doesn't mean they deserve to be treated that way.

Also, Just before a few years immigration was comparatively very easy. People don't even need 60 points to make it. Does this mean we should strip the residence/citizenship of current residents and ask them to apply again or probably stop their benefits because they didn't work very hard when they were applying for the visa? No, they've been working here and paying taxes all these years they and richly deserve it. Similarly, we are not very different than them. We are residents for tax purposes, every one of us is working hard to meet both ends and paying taxes.

In addition, I understand that there could be a delay due to bushfire. My sympathies to the victim but why it is only affecting 887ers? why the decision time of 190 is still 8 months?

I've been struggling to be on top of my things for the last 19 months. We are in a state where mobile companies are not giving us plans, let alone banks lend us a house loan. There is a lot going on in everybody's life which we can't share on a public forum, so all I can say is, I'm in pain ... and I think all of us can feel that even the new applicants shouldn't be relaxed that the delay is not going to hit them. But, unfortunately, we're a group of immigrants who don't know their power.

It’s look like your the only intellectual in this forum who can understand every thing. Sick the head mate

I was giving my opinion, nothing else. It's a pity you had to get nasty about my post simply because you did not like the points raised. I suppose it is easy for someone like you to hide behind your keyboard and to be brave without really adding something constructive to the forum

I appreciate your constructive response. Although I do not agree with everything, I do however agree that this is causing angst and stress for many applicants. I am always positive that everyone on this forum will eventually get a positive result and that the processing time will eventually settle to something more reasonable
