    All,

I have noticed quite a bit of emotional reaction due to lengthy processing times. This is understandable and no doubt everyone has their own frustrations created by their own individual circumstances. Some of our circumstances may be more urgent than others. I have noticed that these emotions have also suggested getting legal assistance. My limited knowledge tells me that this will not provide any resolution because quite simply no law or legislation has been broken and the department are within their rights. Be careful of advice that you may get. No lawyer as far as I am aware has put up a case against the department due to lengthy processing times?

Secondly the processing times of 19 to 22 months is the current measurement of how applications have been processed, not the future. In my opinion 75% is processed within 19 months. 'Within' means before and up to 19 months, that is why there are applicants receiving grants in a 13 to 15 month periods. Another 15% will take longer because they are complicated, and then another 10% beyond 22 months due to further complications, lack of documents, etc

I have also noticed comments that compare the grants of 887 visas to other visa types such as sc190. This is not a good comparison (not apples to apples).Someone indicated that some applicants for the 190's are getting grants after 2 months, which is not a true picture and not an indication of the total period from start of EOI, to invitation, to grant, - it is much longer than 2 months and in most cases longer than a year. Probably similar to when we were granted our 489's for instance. Secondly new 189 and 190 applicants need beyond 80 and even 90 points in some cases, in our day it was only 60 points. Therefore we might not have made it to Oz if we were applying today. Another issue is that we are already in Australia and therefore not priority processing.

I know what I have said does not solve your frustrations but you need to put things into perspective. It is not easy getting to Oz.Also do not assume that CO's are purposely delaying grants, that cannot be the case. There must be circumstances that they are dealing with, for instance the administration of the visas on hold due to coronavirus, etc. I am only guessing, I do not know but I am sure that there is a reason.

If you feel you need to speak to someone then try your local federal MP for instance

My own feelings are that this will not last, I hope. But it is not the end of the world

You maybe right here as my lawyer told me that he called immigration for an other applicant who filed his 887 in February 2018 and got no reply and he was been told that due to bush fire Co’s are busy helping other government departments and went on leave so atm only emergency case officers are working on their files. 🧐

In my opinion you should explain it the same way you have already described it in your post. Keep it simple, tell the truth, it may have been the best method to get tenancy being new to Australia. You can also get a Stat Declaration from your brother if need be.

    Stat declaration. Good idea

Think the reason you have mentioned above is acceptable , back it up with your brothers birth certificate to show it's your brother and documents which shows your husband lives at the property with you

Thanks, what documents you reckon for my husband. Tax assessment, bank statement and phone bill as this all show address on it

Hi there, just to let you know my file is in initial assessment. I got 6 questions to answer🤨

1- our companies nature of business, director and address.

    2- BAS statement for company

    3- business bank statement

4- tenancy agreement 2017-2018( we were living on monthly basis after 1 st year agreement)

5- reason why two other people are on rental agreement and not my spouse(i rent the house by showing my brother’s name with mine as his payslips made it easy to get the house, so tenancy aggreement has my name with my brother)

6- payg summery 2017 has my previous address which is in metro area(my Accountant’s mistake which I didn’t even notice)

    applied 04/10

Any idea about my spouse’s name is not on tenacy agreement, what reason they are looking for?

I know, I cannot wait to resign from my current employer once I get my PR, stressful as hell but hard to find another job on 489 😞

I was in your position, everyone in this forum said quit. I quit now I am jobless😂😂 naaa i quit because I had enough of my boss taking advantage of my visa situation, he thought I would never quit as I need this job.

Nepal I don’t no it’s my bad luck, I have provide all documents they asked for

1 st contact on 23 may asked for English test

2nd AFP they said it’s not clear on 16 th October

I think you should call them everyday. 22 months is not worth waiting for. Worst case scenario, go to your local MP and make him call them. Or pay some $$ to lawyer(not agent) to write immi email and follow up until they give you update.

This information is life saver. How much are you sure about it?

I paid freaking $350 for her 1 hour appointment. Thats how much I am sure about😂😂. You can call immi to clear rest of the doubts but bridging visa also states that if you have the copy with you. You can read it through.

Your visa conditions don't change till your 489 expires; also after that i highly recommend staying in designated area till you get your PR.

I spoke to lawyer yesterday about this she said once 489 over and bridging visa gets activated you are free to move anywhere as it doesn’t come with any conditions. @Mesum

same here. They made a contact on 3rd january for polio vaccine certificate even though  I have not been to Pakistan for more than 28 days...

Yes, we never stayed in pakistan for more than 2 weeks but my friend did so I asked her to get it done and upload it in her file just in case.

    @anna

Can you please share the country you from?... also dont pay the lawyer as you almost there... why you have to pay a big money for absolutely nothing.... you will be fine

my prayers with you and all other 887 applicants 🙂

I am from pakistan. We have more security checks to go through. That’s what happened to my brothers and now same for me. Well I ll only hire a lawyer if I cross 18month period.

No, nothing at all...very sad and disappointing..

    How About you?

I booked an immigration lawyer today and had a meeting with her. Discussed the situation and she thinks that the system mail i got back in September for renewal of my police checks also means that I got case officer assigned back in September. But due to the origin or my country she said they have a set of checks they go through to verify the authenticity of documents provide, she said I can get reply any time soon. If not then in April on 18th month mark I can pay them to represent me and they can follow up till I get my grant.
life is just on hold due to this, not even motivated to find a new job in this shitty town.

Hi Anna, I was asked when I was applying for 489 in 2015 which I got it from Qatar as I was living there  although when I have applied for 887 I did not upload any thing regarding polio certificate and we got approval which means they wont ask. I think it might link of individual travel history whether  he or she is visiting Pakistan frequently or stay longer then they might ask.

Oh okay great, thanks. I ll pass it on.
