I was giving my opinion, nothing else. It's a pity you had to get nasty about my post simply because you did not like the points raised. I suppose it is easy for someone like you to hide behind your keyboard and to be brave without really adding something constructive to the forum

That’s the point when some constructive things happen puppets like you come out and talk shit. Don’t give your preaching and stay away. People like you always find a reason to get away and put down whole team. Learn to stand first and have guts to question princess.

    All,

I have noticed quite a bit of emotional reaction due to lengthy processing times. This is understandable and no doubt everyone has their own frustrations created by their own individual circumstances. Some of our circumstances may be more urgent than others. I have noticed that these emotions have also suggested getting legal assistance. My limited knowledge tells me that this will not provide any resolution because quite simply no law or legislation has been broken and the department are within their rights. Be careful of advice that you may get. No lawyer as far as I am aware has put up a case against the department due to lengthy processing times?

Secondly the processing times of 19 to 22 months is the current measurement of how applications have been processed, not the future. In my opinion 75% is processed within 19 months. 'Within' means before and up to 19 months, that is why there are applicants receiving grants in a 13 to 15 month periods. Another 15% will take longer because they are complicated, and then another 10% beyond 22 months due to further complications, lack of documents, etc

I have also noticed comments that compare the grants of 887 visas to other visa types such as sc190. This is not a good comparison (not apples to apples).Someone indicated that some applicants for the 190's are getting grants after 2 months, which is not a true picture and not an indication of the total period from start of EOI, to invitation, to grant, - it is much longer than 2 months and in most cases longer than a year. Probably similar to when we were granted our 489's for instance. Secondly new 189 and 190 applicants need beyond 80 and even 90 points in some cases, in our day it was only 60 points. Therefore we might not have made it to Oz if we were applying today. Another issue is that we are already in Australia and therefore not priority processing.

I know what I have said does not solve your frustrations but you need to put things into perspective. It is not easy getting to Oz.Also do not assume that CO's are purposely delaying grants, that cannot be the case. There must be circumstances that they are dealing with, for instance the administration of the visas on hold due to coronavirus, etc. I am only guessing, I do not know but I am sure that there is a reason.

If you feel you need to speak to someone then try your local federal MP for instance

My own feelings are that this will not last, I hope. But it is not the end of the world

I am following this forum from last year jan vn I applied for my 887. The funny part of this forum when some one come with some solution to take legal action or approach lawyers or some one told we should all protest in front of assembly to make things moving. Always some one come with all knowledge and finish topic. In simple words immigration is responsible for our mental state of mind and stress. Other hand there is no comparison between 189 and 190 as they come out of quota. We already done 489 so we are here to full fill our condition of living and working so we done with that. The 887 can be done with in 6 months if immi wants but they want to bury us in regional area till we die.
They are many people in forum including me too contribute and pay the fee to lawyers to discuss this issue. And guys who applied in last six month don’t think it’s not ur issue . If we don’t act collectively it will increase to 24 months. If we act by our own we can’t do any thing but collectively can change scenario . Thanks

Grant grant .. Direct grant at 2pm

I would like to share my information.

No. of Applicant: 3 (family with kid 3.5 years old, my son born oversea, came in Australia when he was 3 months old)

    Applied Date: 19/09/2018

Updated the AFP for both and upload on 18/09/2019

Updated Oversea Police Check on 15/11/2019 (we went oversea twice, totally 4 weeks only. Update just in case)

My kid does not need the Medical test as he took when applied 489 Visa

Documents I submitted are the one noted on the document checklist on homeaffair website. I do recommend check the document checklist few times to make sure you uploaded all the requested documents. The step-by-step on the link https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/skilled-regional-887#HowTo is useful.

I also received the generic automatic email sent by Homeaffair on 20/09/2019. I uploaded the updated AFP on 18/09/2019. I think the automatic email is set up before that and recognised I did not upload the updated AFP.

    CO: Andries

Hope you guys here will have grant soon.

    Cheers

Congrats mate. People like u are example of presence of mind. Thanks

Who loves to wait? I don't remember seeing you here when we had terrible times. Not sure how far are you in your waiting time but blaming other applicants for the delay will not get us anywhere.

And when you make DHA move faster through whatever you guys are planning to do, come back and advice us.

It’s not about blaming anyone. It’s all about making immi listen. Two articles published related to delays on 887 visa by sbs. Now applicants are making noise in coming days we will approach lawyers and discuss. If things had been done before the time frame wouldn’t be 19-22 months from 6-8 months in a year.

I suppose we need an immigration lawyer not an agent, first.

Then, we should know how much it is.

Third, we have to do fundraising to pay the lawyer.

The issue is that people are not ready and prefer waiting

Yes I know people prefer waiting. They don’t want change any thing but need everything should change and fix by itself. If we can get applicants who interested then we can approach lawyer. I think every one should take this seriously even though they applied recently as it get down the waiting time for all.

Only the court can probably help us. No other way to beat them up

Can we approach it in a legal way? If that so it vl be great . The applicants before us haven’t done any thing to change circumstances so we are facing worst . We should initiate change it vl be good for people who are going to apply or recently applied. If not just hold urself and talk things which no way going to change process time. Thanks

Immigration is not processing 887, they stuck on something else. We have huge backlog, it has to be cleared up. Increasing processing time will not help anyway, waiting line is getting bigger and bigger.  October stared nothing happening, immigration will not processing any application between Mid December to Mid February.  Don't know what's gonna happen.

That’s correct mate. Undoubtedly we are getting struck for longer time around 18-20 months. Many people in this forum are not interested in time delays they are more eager in baby medical, English requirement , centre link benefit and so on. If you have any suggestions let us know even we can go legal way by paying money  from our pocket.

    Regarding the longer processing time

I think it is un justified because we are all already on a valid visa and all the practice of issuing new Visa shouldn’t be taking much because we are all a residence here so half of the home work to be done by the Dept

I know it is frustrating to every one

    FYI I am hitting 16 and 20 days 😓😓😓😓😓😐😓😐😐😐

It’s frustrating for everyone who is on this visa. Person who applied for 887 visa vl always have a valid visa if 489 expires BV vl be issued. So it’s not about valid visa it’s about permanent residence

Guys, on the processing time received some guidance from a professional Lawyer/Mara agent.

They also agreed what we are doing is fair and reasonable to resolve the situation in the best interest of everyone.

Do we have any contacts with to take this to next level ?  - MPs, Senators and peak bodies such as the MIA, MA, Regional Australia

    Hi Team 887

My apologies for the delayed in responding.

We have discussed this in our firm and think it is highly beneficial for you to be organising as you have done.

We  suggest that you prepare a submission outlining your predicament and start promoting your cause to MPs, Senators and peak bodies such as the MIA, MA, Regional Australia Institute, Scanlon Foundation etc

It would have been helpful to take part in the recent enquiry into this matter, but unfortunately the deadline has passed: https://www.aph.gov.au/Parliamentary_Business/Committees/Joint/Migration/RegionalMigration/Submissions

Nonetheless, it would be useful for you to follow up this inquiry.

We also repeat the suggestion made previously, that you try and enlist media support.

It’s very helpfull information. They are couple of cases where direct grant is given to applicants. We have more cases vn case officer request for additional information. Every one who submit the application vl do 100 percent to upload all papers at the time of application . They can only double check police check that’s it apart from that nothing can be change. If case officer ask some thing out of the box definitely it vl delay application. It’s nothing like decision ready application it’s all depend on case officer. If mrX gets direct grant it doesn’t mean mr Y also gets even though they have same paper and they struggle together. The main issue is why it vl take care officer around 6 months to finalise application after first contact. That’s the main concern it’s just how they want to deal. By giving some direct grants giving false hope to others. 😞😞

  10. To make them hear we should make noise. We checked vth sbs now if possible to go to abc and give them a reference of last two article publish in sbs. If we able to connect this blunder vth new 491 as Govt have no intention to develop regional area as they preaches. If this can be done we have hope if not just regrets and stress.

  12. Guys we should focus on sbs reply and send emails so they can bring up this issue. Some time I feel immi is tracking this forum when group members come together with an idea to bring down waiting time very next hour or day it’s a grant to keep us calm. Too many applications are waiting prior to July but we getting confirmation of August approval. Some thing fishy🤨🤨

So, please get in touch with me when you/other applicants are ready to speak. If there are any concerns about the applicants being identified, I am happy to take those concerns into consideration."

Hope you can Help yourself from here.

    Keep this forum posted.

Context to this offer of assistance from SBS :

    Dear Shamsher,

We hope you are doing well.

We came across your profile on the "SBS website" and noticed that you work on articles related to immigration and being an active new reporter around issues faced by the applicants at various stages of their immigration process . We have case explained below,  which requires some attention. Given your strong background in this space can we request you to cover an article on this issue .

We are a group (750 plus members)  489 (Regional Skilled Visa) applicants  spread across the  regional areas of the country who have applied 887 visa (Permanent visa) in the years 2017/18 & 19.

    About 489 visa (Provisional Visa),

    ·         stay in Australia for 4 years from the date we grant you the visa

    ·         live, work and study in a specified region of Australia

    ·         travel to and from Australia as many times as you want, while the visa is valid

    ·         apply for permanent residence, if eligible, through the Skilled—Regional (Residence) visa (subclass 887)

We wanted to get in touch with you regarding the delays we are facing in processing of our permanent visas,  which in turn is having significant impact on our day to day life.

During the time of the 489 application the processing timeline stated  for 887 visa post completion of compliance to the 489 visa conditions was anywhere between 7 to 8 months. It has now increased almost 3 folds and currently is anywhere between 18 to 21 months as per the information available on the IMMI website. There has been limited information available why such increase has occurred in the time line for onshore applications. At the same time the offshore skilled visa applications are processed in much swift manner as compared to an onshore 887 visa application.

We do appreciate that all the visa cases are to be dealt individually and time line can vary case to case basis. But here we have situation it has just gone one way towards the higher side of things.

The impact it is having on the applicants and their family members is substantial, as the applicants and their family members face struggle, discrimination, eligibility questions in various walks of life due to this delay. Overview of the issue,

    ·         489 visa is valid for 4 years, generally most the 489 visa conditions are to be fulfilled within these period

    ·         Upon compliance to the two year regional stay and one year full time work, the applicants become eligible to apply. Getting a full time work in regional areas is a real struggle for the applicants, some do two or three part time roles to fulfill the conditions

    ·         Most of the applicants are either near to close to their 489 visa expiry or it has already expired, all the applicants receive bridging visa till the permanent visas are processed

    Daily life situation,

    ·         Many of the applicants are on contract employment and the companies find it difficult to extend the contracts since our visa status is not clear

    ·         If the applicants try to apply new roles, they find them not eligible since they do not hold a valid residency status, even though they have full working rights as per immigration department. Most of the companies do not considered this as valid and it is very tedious task to       make them understand and mostly end up losing out on the opportunity

    ·         When these applicants go for utility services such as a basic phone contract they find themselves as not being eligible for  it due to visa constraints

    ·         Many of the family members struggle in educational sector since they do not have permanent residency to be eligible for educational cover

    ·          Some even face issues in extending their house leases due to the visa status as most agents demand the visa copy and bridging visa puts * mark on their housing applications

    ·         Financial services are mostly out of reach as banks do not consider such applicants where the PR is still in processing

    ·         Cannot plan any future travel or go out of the country as it will result in further delays

They are even many other unique and harsh situation faced by the applicants in their daily life.

All this struggle and anguish even after been in compliance to all the visa conditions and doing the hard yards of regional struggle. All these applicants have supported the regional economy across the country in all possible ways and contributed towards economic growth.

    What we expect,

    ·         Lesser processing time of applications, as it was promised to us when we applied the 489 visa ( which was 7/8 months of PR processing)

    ·         Clear and transparent information about the status of the processing of applications, with clear numbers of visa applications lodged, In processing and finalized on a monthly basis along with the total cap for 887 visa to be issued by the department on an annual basis

The applicants have stood to their side of promise/statement of managing the visa conditions and being in compliance at all times, we find the department has been stretching out the timeline too far, which is impacting the daily life of these people.

The applicants have serious ramifications for any breach of visa conditions, it does not seem to have similar result on the department for extending the processing timelines 3 folds in terms of services offered. The increase have significant impact on the applicants in different walks of life.

All these visa applicants have done everything on their own without any government benefits or welfare payments.

The only thing we demand is for the processing timeline to be reduced and clearing of applications in a swift manner.

With the introduction of new regional visa 491 effective from November 2019, it will create two classes of visa holders in regional space.

    1.     A set of applicants who have struggled and worked their way through the process to find themselves stuck again in the processing delays

    2.     The second set would be the new regional visa holders in a much secured position with dedicated government support to achieve the objectives

    3.     We do not envy the situation and are actually glad that government has recognized the need to support people in regional areas as we understand the struggle one has to go through in a space with limited opportunities, but at the same time they should not disregard applicants who have independently achieved and complied with all the conditions and supported the government objective to support and uplift regional economic.

We humbly request you to cover this story and help us to reach out to the department to get the necessary attention and resolve this delay and struggle for all the applicants.

We look upon you with faith and hope. Your support is greatly appreciated by the group and the family members.

Your inputs and insights will be really appreciated.

Help us to get out of this situation.

Look forward to hear back from you.

    Regards,

    Team 887

Really it’s a big thing and all applicant who had processing time above a year should write a email. It’s a 9 month for me but person who applied last year had a span 12 months and above go for it. We should respect to the opportunity or just blame ourself later. Please guys make some efforts so it will be easy for our families.

    What do you propose??

We all should make collective efforts who active or inactive in forum. Can talk to lawyers and ask them to suggest best for us. They just using 887 applicants as tissue paper as we came in a boat. Every one who spend 2 years in regional they have guts so they survive and deserving as other visa category. Vn we got 489 that too came from some quota. We can contribute and make achain of it sooner or later it vl come down to 24 months.

  15. Hello Guys I am new to this forum. Applied on 17 jan 2019. Guys it’s a time to show immi that our life to get effected vth this decisions. Nothing happened in past so it came down to 18 months from 8 months in a year. If nothing happens now it will go back to 24 months in next couple months. So they can put us here for 4 years. We can just satisfy ourselves by listening stories.
