    She was in breach of the 887 conditions for at least 6 months. They normally understand that 3 months is normal to organise the new life. You may get over this with a good explanation. But as @Vinh said, it's risky.

    It's not clear in your message for how long she was in Sydney since you got the 489.

    She moved 6 months after you, but how long did you take to move? (you will need to give a good explanation for the total time in Sydney)

    Thanks @Russki. I have had bad experiences with agents so I am afraid to trust them.  It’s been bloody mystery for us. I am just thinking to withdraw application and apply now in June since her two years residence will complete now. Do you think case officer still may ask?

    Hi Vee Kay,  a big congrats mate for the grant. Can you please share, Was your spouse granted 489 visa with you or after you? 

  4. @A cup of coffee thanks yeah I have heard from many of friends that they only see main applicant and not much about second one. I hope this is the case in ours too 🤞

    @Doman yes I am thinking consulting with lawyer or agent again. Thanks 

    @dar8 even if I apply for myself only. They will ask me later on when I will apply for partner visa and it will disturb our relation may be more. 

    I have already applied on 1/11/18 when I met requirements.

  5. @toot I will be happy to provide stat-dec to prove. We have had very valid family and interfaith reasons to put forward as evidence and also we are from two different countries.  that time we had so much pressure from families as well I think they should understand this genuine concern. People apply for asylum in this situation 😌

    Yes she was still on 489 visa but duration of her work on tax was less than six months.

    Thank you so much guys for your advices. We have messages to each other as a proof they were breaking up and that time I could not inform immigration about that because it would have been very early and my partner could not have any choice. we already passed those 3 months period when 489 approved and I moved. So it’s 6 months literally but we have valid family reasons. I had consulted with Acacia Migration few months before on paid consultation and they advised that visa officer may ask for it but they may be convinced when you state your situation as we have been together for a very long time. Or visa officer might ask to apply later when her 2 years are also completed.

     I and my defecto partner were granted 489 visa together so I only moved to regional 6 months before her and she was still in Sydney and worked in tax job. due to personal relationships issues between us. Then things were sorted and she moved regional with me and I applied for 887 visa after I completed work and residence requirements being a main applicant. Do you guys think the visa officer will ask the question on her being non-compliant

    I am a silent follower and I applied on 1/11/2018, can you guys please add me to spread sheet? 

    I have a question if you could help me clarify from your knowledge and experience.

    You and your partner both have to be onshore while applying for 887. How ever once you have applied you can still travel outside Australia but remember to updated the department about your travel details.

    Thanks. I did figured out that but I was concerned only for longer it takes these days.

    Thanks a lot for your help. It’s just I don’t want to lose 2 month because I have already planned my trip and fixed everything. Will have to apply in December now.

  11. Hi guys, 

    I am silent follower of the this forum. I really appreciate all you guys helping each other! 

    I am actually in bit of confusion about my scenario. I am due to apply end of the month and my partner is away due to her father medical emergency. I am just wondering should I still lodge my 887 application or wait for her because I have to travel in November and she won’t be back until then? Looking at processing times I am worried that I will be late. 

    Need your suggestions please.

    1) You stayed overseas 3 months out of this 2 years which will be completing in july 2018. If you had paid holidays of 4 weeks during your overseas visit then i would advise you to compensate 2 months extra meaning you should apply 887 visa at the start of October 2018. 

    2) If you have statutory declaration attested/approved by JP that is enough but again it depends on Case officer so it would be better to have more documents to proof for this period of residency such as Mobile phone bills on this address, Utility bills on your name for this address, Car registration or insurance letter on this address etc etc.

    I am going to apply 887 visa tonight. And i went overseas for 8 weeks in first year and 6 weeks in second year. My two years completed on 19th feb 2018 and i did compensate extra 2 months.

    Hope guys are doing well! I am new to this forum and I have few questions in my mind regarding visa application. I thank you in advance for your valuable thoughts. 

    1) I am going to apply for 887 in August, my 2 years will complete in the end of July 2018. I went overseas 9 weeks in first year and again had to go 3 weeks due to emergency in same year but no holidays at all after that. Do you advise that I should cover whole 9 weeks period? 

    2) For my first 6 months stay in regional area ( that includes above holidays) I have only a stat declaration from a friend where I lived and some transactions in my Statement. Do you think it’s sufficient?
