887 Visa - What's the update?

Hi all, 

I'm setting up a whatsapp group where we can plan strategies, compose letters, have them proofread and signed, do a social media campaign and whatever else we could do to pull it off.

The current thread is not suitable for that because people are asking, sharing various others things that are not related to the campaign.  

If you want to be a part of it, send me your whatsapp numbers on 0 4 1 2 2 9 9 7 6 8 .  Please also encourage other related (only) people to join the cause. More people will allow us to build more pressure on authorities.

The group will be moderated strictly (So need few admins) and it will be ensured that all group members will adhere to the purpose of the cause. 

Remember, there is a high possibility that you'll be greeted by a further extended waiting period anytime you login to your immi account. We won't be able to do anything when they'll make it 24-25 months if we don't do it now.

It's nice all initiatives (tweet, FB, media etc) to put pressure on them, but I reckon it will make few or nil effect.

We have 2 options, sit and wait or a class action. A lawsuit against them, moved by the group, to repair the damages caused by their negligence. The main argument is; we made our decision to immigrate to Australia based on a set of conditions informed by the government at that time (2-3 years ago). They are not compliant with their side of the agreement which is causing pain, stress and financial problems.

I have no intention to receive any financial compensation for it, but a real court case in a Federal court will put real pressure on them. We made a deal with Australian government 2-3 years ago, they need to honor their part.

It's easy for us to demonstrate the extra cost we are incurring due their delay. Again, I don't care about receiving anything back, it's just to put pressure on the most sensitive organ of the human body, the pockets.

There is a risk. They may say; 'ok, you want us to assess your application? fine, we reject all. finished'.

But this risk is also present when we put pressure through media etc....

Opinions???

I have already looked into this option @George. 🙂 Good idea, but...

I know the lawyer even who is prepared to file a case for us in federal Court, he is a top-notch lawyer and we are almost guaranteed to win the case. However, each of us have to pay up to $7000 to start the ball rolling. We will get this money back in case of success, but we may not. Are you guys prepared to do this??? I don't have this money spare, sure enough. 

But good idea, I agree. And I looked into the law side of thisng, we can claim "unreasonable amount of time to take a decision " in court, you can read on it: Section 7(1) of the Administrative Decision (Judicial Review) Act 19977 (ADJR Act). 

And no, they will not reject our applications if we take a class action, because they know that they will be under scrutiny if they do. 😉

I believe this $7k is mostly related with the solicitor/lawyer fees (plus accountants and other specialists to build up the case). The court fees are not that high. Can you confirm this with the lawyer?

If the $7k is mostly for the lawyer team, we shall have a reduction per person if we have several applicants under the same claim.

Discuss with him the possibility to increase his/her success fee and reduce the initial cost. (They can keep 100% of what he/she recuperates in excess of the the $7k)

If I can have 100% guarantee my 887 will be granted in one month, I pay the $7k now (not saying I have it spare, but it's a valid sacrifice).

I can certainly send a query to the lawyer and ask about fees, time it will take, our role in it, what is involved. 🙂

But in the first instance, we should try ombudsman complaints. If we do it simultaneously, in bulk, this should have some effect, you'd think? let's decide on the date/week and do it all together. See what happens. Just remember that the case should already have a history of complaints to the Department first. 

So if your case is over 12 months old and you already complaint 3 times to the Department, you can proceed with the complaint to Ombudsman.

Just  check the fees but I am sure it will be higher than 7k. Secondly we can get free lawyer from gov aren’t we ?

14 Months I've been held hostage to this system, waiting for something to happen in regards to 489 - 887 visa, now struggling to find work because who's going to employ someone that's in "no mans land"? Bridging Visa.

Like most people on here Id never of gone for the 489 what a joke, I may have to leave before i get an answer due to financial reasons.

The 489 should be called the never ending answer visa .......this would be way more honest i think.

I spoke to an ex employee 2 weeks ago who worked for immigration here in Adelaide, she said they will only grant a fixed amount of 887's a month and are closely

controlled by Canberra. Due to lack of staff and finacial input from the government, im not sure complaints about the department will do anything.

Im all up for it and count me in but realistically is it going to make any difference?. I guess we can try but il probably be doing it from the uk .......:(

Unfortunately it's true Russki I uploaded form 1022 onto immiaccount with passport birth certificate and did a follow up email to team10adelaide email address.all this I did 9months ago and I v been calling immi to check only yesterday I got told to post form 1022 instead if I want 489 for my daughter.

Hi guys 

i need a help. I applied for 887 pr and waiting. Me and my wife are the persons included in the application. I am the main applicant. Can my wife leave australia and stay in another country until the decision is made? Do i need to update this with immigration?, if so do they gonna ask for police clearance from that country?

Hello - you do not need to update anyone and your partner can travel but please remember that at the time of decision your partner should be onshore; incase she is not here CO might get in touch with and let you know that they are making decision and will grant once your partner is onshore. Please note that we have seen cases in which applicants had to wait for longer duration to get the final grant. All the best!

This doesn’t seem true because 887 applications have been decreased and deliberately they are increasing  processing time.

Public service in the government should not get involved in politics in order to ensure efficient and timely delivery of service, regardless of any sitting political party (be labor, liberal, national, etc.)

That's why we are asking an independent Commonwealth body, the Commonwealth Ombudsman to investigate.

And should they find an offence of abuse of public office - s.142.2(1) Criminal Code, we ask the Commonwealth Director of Public Prosecutions to prosecute and take these public officials to court.
